By using mylifeguard.net (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree — including the mandatory arbitration provision and class action waiver in the Dispute Resolution section — please do not use the Site.

Who We Are

The Site is operated by Blaney Group LLC ("we," "us," "our"), a Puerto Rico limited liability company. MyLifeGuard and Lifeguard Network are brand names we use; the operating company is Blaney Group LLC.

Eligibility

You must be at least 18 years old to use the Site or submit any form. By using the Site, you represent that you are 18 or older. If you are a parent or guardian of someone under 18 who uses the Site, you accept these Terms on their behalf.

What We Offer

We provide free educational resources — including will kits and estate planning guides — and connect interested visitors with licensed insurance professionals who can answer questions about coverage. Our materials are general information, not legal, financial, tax, or insurance advice. For decisions about your specific situation, consult a qualified professional.

When you submit a request through our forms, we share your contact information with licensed insurance professionals and partner carriers (including American Income Life Insurance Company and Globe Life And Accident Insurance Company), who may contact you about coverage. Communications (TCPA)

We do not send marketing text messages directly. When you submit your phone number, you consent to be contacted — including by automated calls and text messages — by the licensed agents and carriers we share your information with. Consent is not a condition of receiving our free resources. To stop messages from a partner, reply STOP to their texts, click the unsubscribe link in their emails, or contact them directly.

Intellectual Property

All content on the Site — including text, graphics, logos, images, and software — is owned by Blaney Group LLC or its licensors and is protected by U.S. and international copyright and trademark law. You may view and download materials for your personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works without our prior written permission.

The MyLifeGuard and Lifeguard Network names and related logos are trademarks of Blaney Group LLC. Unauthorized use is prohibited.

Disclaimers

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.

We do not control the licensed agents and carriers we share your information with. They are independent third parties, and we are not responsible for their conduct, communications, products, or practices. Any insurance product or service you obtain from them is a transaction between you and that third party.

Nothing on the Site constitutes legal, financial, tax, or insurance advice. Always consult a qualified professional for advice about your specific situation.

Limitation of Liability

To the fullest extent permitted by law, Blaney Group LLC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages — including lost profits, loss of data, or damages from business interruption — arising from or related to your use of the Site, even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claim arising from these Terms or your use of the Site will not exceed one hundred dollars ($100).

Some jurisdictions do not allow certain limitations or exclusions, so the above may not apply to you in full.

Indemnification

You agree to indemnify, defend, and hold harmless Blaney Group LLC and its officers, directors, employees, and agents from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from (a) your use of the Site, (b) your violation of these Terms, (c) your violation of any law or the rights of any third party, or (d) information you submit through any form.

Dispute Resolution; Binding Arbitration

Please read this section carefully — it affects your legal rights.

Any dispute arising out of or related to these Terms or your use of the Site will be resolved through binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, in San Juan, Puerto Rico. The arbitrator’s award will be final and enforceable in any court of competent jurisdiction.

Class action waiver. You and Blaney Group LLC agree that disputes will be resolved solely through individual arbitration. You waive the right to bring or participate in any class action, collective action, or representative proceeding. The arbitrator may not consolidate claims from multiple parties.

Exceptions. Either party may bring an individual claim in small claims court if eligible, and either party may seek injunctive relief in court for the alleged infringement of intellectual property rights.

Opt-out. You may opt out of arbitration by sending written notice to hello@lifeguard.network within 30 days of first agreeing to these Terms. Your notice must include your full name and a clear statement that you opt out. If you opt out, disputes will instead be resolved in the courts identified in the Governing Law section.

Statute of limitations. Any claim arising from these Terms or your use of the Site must be filed within one (1) year of the event giving rise to the claim, or it is permanently barred.

This arbitration agreement is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq.

Governing Law

These Terms and any dispute arising under them are governed by the laws of the Commonwealth of Puerto Rico, without regard to its conflict-of-laws principles. Disputes not subject to arbitration (or where a party has opted out) will be resolved in the state or federal courts located in San Juan, Puerto Rico, and you consent to the personal jurisdiction of those courts.

Termination

We may suspend or terminate your access to the Site at any time, for any reason or no reason, without notice. You may stop using the Site at any time.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. If we make material changes, we will note them on the Site. Your continued use of the Site after changes are posted means you accept the updated Terms.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full effect, and the unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
